Welcome to Flow Motion Logistics. These Terms and Conditions (“Terms”) govern your use of our courier services including Air Freight, Sea Freight, Online Credit Card Purchases, and Barrel Clearance (“Services”). By engaging our Services, you agree to comply with these Terms. Please read carefully.

3.1 Air Freight: Transportation of goods by air, prioritizing speed and safety. Standard delivery timeframe is 2-5 business days islandwide.
3.2 Sea Freight: Economical transportation by sea, suitable for bulk and heavy items. Standard delivery timeframe is 10-21 business days islandwide.
3.3 Online Credit Card Purchases: Secure processing and handling of customer online purchases with credit card payment, including order verification and shipping.
3.4 Barrel Clearance: Specialized customs clearance services for barrels containing personal or commercial goods, ensuring compliance with Jamaican customs regulations and timely delivery.
3.5 Special Services: Safe handling of packages and guaranteed on-time delivery within the specified timeframes.
4.1 Packaging: Customers must ensure items are securely and appropriately packaged to prevent damage during transit. Flow Motion Logistics is not liable for damage resulting from inadequate packaging.
4.2 Documentation: Customers must provide all necessary and accurate documentation (including customs forms, invoices, and delivery instructions) prior to shipment.
4.3 Prohibited Items: Customers shall not ship items listed under Section 8 (Prohibited Items). Failure to comply will result in shipment refusal or legal action.
5.1 Care Standards: Flow Motion Logistics commits to handling all shipments with due care and professionalism.
5.2 Delivery Commitments: We aim to meet the specified delivery timeframes. However, delivery times may vary due to external factors (see Section 8 on Force Majeure).
5.3 Customer Service: We provide responsive support for shipment tracking, inquiries, and dispute resolution during business hours.
6.1 Fee Structure: Charges are based on weight (per pound) and dimensional weight where applicable. Prices vary depending on service type (Air Freight, Sea Freight, etc.) and destination.
6.2 Additional Charges: Handling fees, customs duties, taxes, and storage fees may apply and will be communicated prior to shipment.
6.3 Payment Terms: All payments must be made upfront via credit card, bank transfer, or other approved methods before shipment processing.
7.1 Coverage Limits: Flow Motion Logistics’ liability for loss, damage, or delay is limited to a maximum of JMD 50,000 per shipment unless additional insurance is purchased.
7.2 Damage Claims Process: Claims must be reported within 7 calendar days of delivery with supporting evidence. Claims submitted after this period will not be accepted.
7.3 Insurance: Customers may purchase additional insurance coverage for higher value shipments at an additional cost.
8.1 Customers are prohibited from shipping:
Illegal drugs, narcotics, or controlled substances
Firearms, ammunition, explosives, and hazardous materials
Perishable goods without prior approval
Items prohibited by Jamaican customs and laws, including counterfeit goods and certain agricultural products
Any item that violates Jamaican law or international regulations
8.2 Flow Motion Logistics reserves the right to refuse shipment of any prohibited or suspicious items.
9.1 Timeframes: Delivery will be made within the timeframes specified in Section 3, subject to unforeseen delays.
9.2 Failed Delivery: If delivery fails due to incorrect address, unavailability of the recipient, or refusal to accept the shipment, the package will be held for up to 7 days. Storage fees of JMD 1,000 per day apply thereafter.
9.3 Storage Fees: Unclaimed shipments after 30 days may be returned to sender or disposed of at Flow Motion Logistics’ discretion.
Flow Motion Logistics shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to:
Natural disasters, extreme weather, or pandemics
Customs inspections and clearance delays
Government actions, restrictions, or embargoes
Strikes, labor disputes, or transportation disruptions
11.1 Complaints: Customers must notify Flow Motion Logistics of any complaints within 7 days of service to allow for investigation and resolution.
11.2 Governing Law: These Terms are governed by the laws of Jamaica. Any disputes shall be subject to the exclusive jurisdiction of Jamaican courts.
12.1 Flow Motion Logistics collects and processes customer data to provide services, process payments, and comply with legal obligations.
12.2 Customer data will not be shared with third parties except as required for service delivery or by law.
12.3 We implement reasonable security measures to protect customer information.
Flow Motion Logistics reserves the right to modify these Terms at any time. Changes will be posted on our website and communicated to customers. Continued use of our Services after modifications constitutes acceptance of the updated Terms.
14.1 Either party may terminate the service relationship with written notice.
14.2 Flow Motion Logistics may suspend or terminate services for breach of these Terms or illegal activities.
14.3 Upon termination, all outstanding fees remain payable and outstanding shipments will be processed per these Terms.
15.1 Refund requests must be submitted in writing within 7 days of service.
15.2 Refunds are at the discretion of Flow Motion Logistics, subject to investigation and evidence of service failure.
15.3 Approved refunds will be processed using the original payment method within 14 business days.
16.1 Flow Motion Logistics is not responsible for customs duties, taxes, or penalties imposed by Jamaican authorities.
16.2 The company disclaims liability for indirect, incidental, or consequential damages arising from service use.
16.3 Customers agree to indemnify and hold harmless Flow Motion Logistics from claims related to prohibited or illegal items shipped.
